MANBILITY | TERMS AND CONDITIONS
1. DEFINITIONS
"We", "Us", "Our", "Manbility": Refers to Manbility LLP.
"You", "Your": All persons named in the booking.
"Trip", "Retreat", "Expedition": Any travel arrangement or event featured on our website.
"Supplier/Principal": The third-party provider of specific trip elements (e.g., accommodation or specialized activities).
2. YOUR BOOKING
2.1 Contract: A binding contract exists as soon as we issue your Booking Invoice. By booking, you accept these terms and those of the specific Supplier/Principal. 2.2 Agency Status: We act as an agent for Suppliers but also as a Package Organiser where we bundle services. 2.3 Authority: The person making the booking must be at least 18 years old and authorized by all members of the party to accept these conditions. 2.4 Accuracy: You must check your Booking Invoice immediately. We are not liable for inaccuracies not reported in writing within 7 days of issue.
3. PAYMENTS & PRICING
3.1 Deposits: A non-refundable deposit is required at the time of booking. Your spot is not secured until this payment is received. 3.2 Balance: The full balance must be paid by the due date provided at booking. Failure to pay on time may result in cancellation by the Supplier and the application of cancellation fees. 3.3 Price Adjustments: We reserve the right to alter advertised prices. For international trips, the final balance may be subject to currency conversion rates at the time of final payment.
4. CANCELLATIONS & AMENDMENTS BY YOU
4.1 Notice: Cancellations must be sent via email to contact@manbility.co.uk. Notice is only effective when received by us. 4.2 Standard Cancellation Charges:
45 Days or MORE before departure: Loss of deposit (or 30% of total trip cost, whichever is greater).
44 Days or LESS before departure: 100% of total trip cost. 4.3 Specific Arrangements: Certain tours (e.g., those involving non-refundable flights) may carry higher cancellation fees. You will be advised of these at the time of booking. 4.4 Amendments: We reserve the right to charge an administration fee of £65 for any changes requested to your booking after the invoice has been issued.
5. CANCELLATIONS & CHANGES BY US
5.1 Minimum Numbers: If a trip fails to reach its minimum group size 14 days before departure, we will cancel the trip and provide a full refund. 5.2 Adverse Weather: We prioritize safety. We may alter itineraries to accommodate weather conditions without refund. If weather makes a trip entirely unsafe, we will offer a reschedule or credit. 5.3 Liability Limitation: If we cancel a trip, we are not responsible for costs incurred for independent travel arrangements (flights, trains, etc.). We strongly recommend flexible travel bookings.
6. FORCE MAJEURE
We will not be liable for compensation if our obligations are affected by "Force Majeure"—events beyond our control such as warfare, terrorism, significant risks to human health (e.g., pandemic outbreaks), natural disasters, or industrial disputes.
7. INSURANCE & HEALTH
7.1 Mandatory Insurance: You must take out suitable travel insurance at the time of booking. This must cover cancellation, medical emergencies, and the specific activities included in your trip. 7.2 Health Disclosure: You must provide full details of any medical conditions or disabilities at the time of booking. We reserve the right to refuse or cancel a booking if the trip is not suitable for your medical requirements. 7.3 Inherent Risk: You acknowledge that adventure sports and expeditions carry risks. Manbility assumes no liability for injury or death occurred while participating in trip activities.
8. YOUR RESPONSIBILITIES
8.1 Behaviour: If your behavior is deemed disruptive, dangerous, or upsetting to others, we or the Supplier may terminate your trip immediately without refund. 8.2 Damage: You are liable for any damage caused by you or your party to property. Payment must be made directly to the Supplier/Principal at the time. 8.3 Travel to Site: We are not responsible for your travel to the trip starting point. Car-sharing with other guests is done entirely at your own risk.
9. DATA PROTECTION (UK GDPR)
9.1 Processing: We process your personal data (including sensitive health data) in accordance with the UK GDPR and the Data Protection Act 2018. 9.2 Disclosure: Information is only shared with Suppliers/Principals as necessary to deliver your trip. 9.3 Consent: By booking, you consent to us sharing relevant information with insurers or medical staff in the event of an emergency.
10. LAW AND JURISDICTION
These terms are governed by English Law, and any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
